§ 1 GENERAL PROVISIONS

The store at www.fugo.shop operates under the rules set forth in these Terms and Conditions.

These Terms and Conditions define the conditions for concluding and terminating Product Sales Agreements, the complaint procedure, the types and scope of services provided electronically by the Store, the rules for providing these services, and the conditions for concluding and terminating agreements for the provision of electronic services.

Every Service Recipient, upon taking steps to use the Electronic Services of the Store, is obliged to comply with the provisions of these Terms and Conditions.

In matters not regulated by these Terms and Conditions, the following provisions shall apply:

4.2. The Consumer Rights Act of May 30, 2014;

4.3. The Act on Out-of-Court Settlement of Consumer Disputes of September 23, 2016;

§ 2 DEFINITIONS

CONTACT FORM – a form available on the website allowing messages to be sent to the Service Provider.

REGISTRATION FORM – a form available on the website allowing the creation of an Account.

ORDER FORM – a form available on the website allowing the placement of an Order.

CUSTOMER – a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller.

CONSUMER – a natural person performing a legal transaction with an entrepreneur not directly related to their business or professional activity.

ACCOUNT – a collection of resources in the Service Provider’s ICT system, marked with an individual login and password, where the Service Recipient’s data and information about placed Orders are collected.

NEWSLETTER – an Electronic Service allowing the Service Recipient to subscribe to and receive free information from the Service Provider regarding the Store and Products.

PRODUCT – a movable item or service available in the Store which is the subject of the Sales Agreement.

REVIEW SYSTEM – an Electronic Service provided to Customers to post reviews regarding Products.

SALES AGREEMENT – a Product Sales Agreement concluded between the Customer and the Seller via the Store.

ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Store.
-
SERVICE RECIPIENT – a natural person, legal person, or an organizational unit without legal personality to whom the law grants legal capacity, using the Electronic Service.

ORDER – the Customer's declaration of intent constituting an offer to conclude a Product Sales Agreement with the Seller.
§ 3 PRODUCT INFORMATION AND ORDERING

The Store conducts retail sales of Products via the Internet.

Products offered in the Store are new, free from physical and legal defects, and have been legally introduced to the Polish market.

Information on the Store's website does not constitute an offer within the meaning of the law. By placing an Order, the Customer makes an offer to buy a specific Product under the conditions provided in its description.

The Product price displayed on the website is given in Polish Zloty (PLN) and/or Euro (EUR) and includes all components, including VAT. The price does not include delivery costs.

The price displayed at the time of placing the Order is binding.

Orders can be placed 24/7 through the Order Form on the website.

To place an Order, the Customer is required to register an Account in the Store.

Registration and acceptance of these Terms and Conditions are required to place an Order.

Orders are processed Monday to Friday during business hours (10:00 AM – 6:00 PM). Orders placed after 6:00 PM or on weekends/holidays will be processed the next business day.
§ 4 CONCLUSION OF THE SALES AGREEMENT

To conclude a Sales Agreement, the Customer must first place an Order.

After placing the Order, the Seller immediately confirms its receipt.

Confirmation of receipt (sent via e-mail) binds the Customer to their Order.

The confirmation contains essential Order details, a withdrawal form, and these Terms and Conditions.

The Sales Agreement is concluded upon the Customer receiving the aforementioned e-mail.

Processing begins immediately after payment is received.

Every agreement is confirmed by a proof of purchase (receipt or VAT invoice) attached to the Product.
§ 5 PAYMENT METHODS

Available payment methods:

1.2. Electronic payment services (Przelewy24.pl, Visa, MasterCard).

1.3. Cash on delivery.

For bank transfers, use the Millennium Bank accounts: PLN: 69 1160 2202 0000 0003 6576 0954 or EUR: 41 1160 2202 0000 0003 7077 0732. Use "Order No. ..." as the transfer title.

For electronic payments, payment must be made before processing begins.

For cash on delivery, the package is sent after address verification.

Payment must be made within 3 business days of concluding the agreement unless stated otherwise.
§ 6 DELIVERY: COSTS, TIME, AND METHODS

Delivery costs are determined during the ordering process based on the payment and delivery method.

Delivery time = Preparation time (up to 1 business day) + Carrier delivery time (1 to 2 business days).

Products are shipped worldwide via courier.

Tobacco products purchased in the store are available for personal pickup only.

The maximum weight per order is 30 kg. Heavier orders require separate placements.
§ 7 COMPLAINTS (WARRANTY AND STATUTORY WARRANTY)

Seller's Warranty: Products have a Seller's warranty valid in Poland. The period depends on the category specified on the website. Proof of purchase is required.

Liability for defects is based on the Civil Code.

§ 8 RIGHT OF WITHDRAWAL

Consumers (and eligible entrepreneurs under §10) may withdraw from a distance agreement within 14 days without giving a reason.

Upon withdrawal, the agreement is void. The Product must be returned within 14 days.

The Customer is liable for any diminished value of the Product resulting from handling beyond what is necessary to establish its nature and function.

The Seller refunds the Product price and delivery (standard rate) within 14 days using the same payment method.

Exceptions to withdrawal: customized/non-prefabricated goods, sealed hygiene goods opened after delivery, goods inseparably mixed with others, fully performed services, and perishable goods.
§ 9 PROVISIONS FOR BUSINESSES (B2B)

This section applies to entrepreneurs not covered by consumer protection.

The Seller may withdraw from a B2B agreement within 14 business days without reason.

The Seller may limit payment methods or require prepayment for B2B customers.

Risk of loss passes to the B2B Customer once the Product is handed to the carrier.

B2B Customers must inspect the package upon delivery and initiate carrier liability if damaged.
§ 10 SOLE PROPRIETORSHIPS WITH CONSUMER RIGHTS

Natural persons running a business are covered by consumer protection (regarding clauses, statutory warranty, and withdrawal) if the purchase is not of a professional nature for them.

Professional nature is verified via the CEIDG (PKD codes).

These entities are not covered by institutional protection (e.g., Consumer Ombudsmen).
§ 11-14 ELECTRONIC SERVICES AND TECHNICAL REQUIREMENTS

Services: Sales Agreements, Account management, Review System, and Newsletter.

Electronic services are free of charge.

Technical requirements: Computer/mobile with Internet, e-mail, web browser, Cookies, and JavaScript enabled.

Users are prohibited from providing unlawful content.

§ 15 INTELLECTUAL PROPERTY

All content on www.fugo.shop is protected by copyright and is the property of FUGO GROUP Sp. z o.o.

Any unauthorized use of the content constitutes a violation of the law and results in civil and criminal liability.
§ 16 FINAL PROVISIONS

Agreements are concluded under Polish law.

Disputes with Consumers will be resolved through negotiation first. If failed, the competent common court will decide.

B2B disputes are settled by the court competent for the Seller's seat.

Consumers may use out-of-court dispute resolution (ODR platform: http://ec.europa.eu/consumers/odr/).
