PRIVACY POLICY OF THE ONLINE STORE

§ 1. GENERAL PROVISIONS

  1. The administrator of personal data collected via the online Store www.fugo.shop is FUGO GROUP Spółka z ograniczoną odpowiedzialnością (limited liability company) entered into the register of entrepreneurs by the District Court for the capital city of Warsaw in Warsaw, XII Commercial Division of the National Court Register under the number KRS: 0000759296.

    • Hereinafter referred to as the "Administrator" and simultaneously being the "Service Provider".

  2. Personal data collected by the Administrator via the website are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR.

  3. Any words or expressions written in the text of this Privacy Policy with a capital letter should be understood in accordance with their definition contained in the Terms and Conditions of the online Store www.fugo.shop.

§ 2. TYPE OF PERSONAL DATA PROCESSED, PURPOSE AND SCOPE OF DATA COLLECTION

  1. PURPOSE OF PROCESSING AND LEGAL BASIS. The Administrator processes personal data of the Service Recipients of the Store www.fugo.shop in the case of:

    • a) Registration of an Account in the Store, in order to create an individual account and manage that Account, based on Art. 6(1)(b) of the GDPR (performance of a contract for the provision of services by electronic means).

    • b) Placing an order in the Store, in order to perform the sales contract, based on Art. 6(1)(b) of the GDPR (performance of a sales contract).

    • c) Subscribing to the Newsletter in order to send commercial information by electronic means, based on Art. 6(1)(a) of the GDPR (consent).

  2. TYPE OF PERSONAL DATA PROCESSED. The Service Recipient provides the following data:

    • a) For an Account: First name and surname, Login, Address, E-mail address.

    • b) For an Order: First name and surname, Address, Tax ID (NIP), E-mail address, Telephone number.

    • c) For the Newsletter: First name and surname, E-mail address.

  3. PERSONAL DATA ARCHIVING PERIOD. The personal data are stored by the Administrator:

    • a) In the event that the basis is the performance of a contract: for as long as it is necessary for the performance of the contract, and after that time for a period corresponding to the limitation period for claims (usually 6 years, or 3 years for business-related claims).

    • b) In the event that the basis is consent: until the consent is revoked, and after revocation, for a period corresponding to the limitation period for claims.

  4. While using the Store, additional information may be collected, such as: IP address, domain name, browser type, access time, and operating system type.

  5. Providing personal data by the Service Recipient is voluntary.

§ 3. SHARING OF PERSONAL DATA

  1. Personal data of Service Recipients are transferred to service providers used by the Administrator, in particular to:

    • a) Entities performing the delivery of Products.

    • b) Payment system providers.

    • c) Accounting offices and hosting providers.

    • d) Software providers (accounting, mailing, and e-commerce systems).

  2. Personal data of Service Recipients are stored exclusively within the European Economic Area (EEA), subject to §5 point 5 and §6 of this Policy.

§ 4. RIGHT OF CONTROL, ACCESS, AND CORRECTION

  1. The data subject has the right to access, rectify, erase ("right to be forgotten"), or restrict processing. They also have the right to data portability, the right to object, and the right to withdraw consent at any time.

  2. To exercise these rights, the Service Recipient can send an e-mail to: shisha@fugo.shop.

  3. The Administrator shall fulfill or refuse the request immediately, no later than within one month of receipt.

§ 5. "COOKIES" FILES

  1. The Store's website uses "cookies" — small text files necessary for the proper functioning of the site and for statistical purposes.

  2. The website uses two types of cookies:

    • a) "Session" cookies: Temporary files deleted after logging out or closing the browser.

    • b) "Persistent" cookies: Stored for a specified period or until deleted by the user.

  3. The Administrator uses external cookies (e.g., Google Analytics) to collect anonymous statistical data.

§ 6. ADDITIONAL SERVICES AND SOCIAL PLUGINS

  1. The Store uses social plugins from services such as Facebook, Instagram, YouTube, and Google. When visiting the site, the browser establishes a direct connection with the servers of these providers.

  2. If the Service Recipient is logged into a social network, the provider can assign the visit directly to their profile. To prevent this, the user must log out of social networks before visiting www.fugo.shop.

  3. The Store also uses remarketing tools, such as Google AdWords, to display tailored advertisements.

§ 7. FINAL PROVISIONS

  1. The Administrator applies technical and organizational measures to protect personal data against unauthorized disclosure, loss, or destruction.

  2. In matters not regulated by this Privacy Policy, the provisions of the GDPR and other relevant provisions of Polish law shall apply.
